Voice In Color. respects the privacy of every individual who visits our Web sites, responds to our interactive advertisements or sends us e-mail. This Privacy Statement outlines the information Voice In Color will collect and how we will use that information. Voice In Color order forms will be sent and will arrive privately and unaltered at a Voice In Color server. This security prohibits other companies and Web users from being able to access your information. Voice In Color will not collect any personally-identifiable information about you (that is, your name, address, telephone number, or email address) unless you provide it to us voluntarily.

 

Voice In Color Account Holders

Any private information collected from Voice In Color account holders will never be displayed or shared with public or other companies. If you are not an account holder for paid services, or do not want your personally-identifiable information collected, please do not submit it to us. If you were an account holder or potential costumer who have already submitted  this information and would like for us to remove it from our records, please contact us at the email address listed at the bottom of this Statement. We will use reasonable efforts to delete your information from our existing files.

Terms of Service Agreement

Please read this Agreement carefully before using Voice In Color services. By purchasing or accessing any part of the web site, you agree to become bound by the terms and conditions of this agreement. If you do not agree to all the terms and conditions of this agreement, then you may not use any services on this site. Voice In Color is available only to individuals who are at least 18 years old.

1. Your Voice In Color Account and website. If you purchase a hosting plan, you are responsible for maintaining the security of your account, website, and you are fully responsible for all activities that occur under the account and any other actions taken in connection with the account. You must not describe or assign keywords to your websites in a misleading or unlawful manner, including in a manner intended to trade on the name or reputation of others.  You must immediately notify  Voice In Color of any unauthorized use of your account, or other breaches of security. Voice In Color will not be liable for any acts or omissions by You, including any damages of any kind incurred as a result of such acts or omissions.

2. Responsibility of Contributors. By making Content available, you represent and warrant that:

   • the downloading, copying and use of the Content will not infringe the proprietary rights, including but not limited to the copyright, patent, trademark or trade secret rights, of any third party;

   • if your employer has rights to intellectual property you create, you have either (i) received permission from your employer to post or make available the Content, including but not limited to any software, or (ii) secured from your employer a waiver as to all rights in or to the Content;

   • you have fully complied with any third-party licenses relating to the Content, and have done all things necessary to successfully pass through to end users any required terms;

   • the Content does not contain or install any viruses, worms, malware, Trojan horses or other harmful or destructive content;

   • the Content is not spam, is not machine- or randomly-generated, and does not contain unethical or unwanted commercial content designed to drive traffic to third party sites or boost the search engine rankings of third party sites, or to further unlawful acts (such as phishing) or mislead recipients as to the source of the material (such as spoofing);

   • the Content is not obscene, libelous or defamatory, hateful, racially or ethnically objectionable, and does not violate the privacy or publicity rights of any third party;

   Without limiting any of those representations or warranties, Voice In Color has the right (though not the obligation) to refuse or remove any content that, in Voice In Color reasonable opinion, which violates any Voice In Color policy or is in any way harmful or objectionable, or terminate or deny access to and use of the account to any individual or entity for any reason, in Voice In Color sole discretion. Voice In Color will have no obligation to provide a refund of any amounts previously paid.

3. Responsibility of Website Visitors. Voice In Color cannot review, all of the material, including computer software, posted to the accounts, and cannot therefore be responsible for that material’s content, use or effects. By operating or visiting the websites, Voice In Color does not represent or imply that it endorses the material there posted, or that it believes such material to be accurate, useful or non-harmful. You are responsible for taking precautions as necessary to protect yourself and your computer systems from viruses, worms, Trojan horses, and other harmful or destructive content. The Website may contain content that is offensive, indecent, or otherwise objectionable, as well as content containing technical inaccuracies, typographical mistakes, and other errors. The Website may also contain material that violates the privacy or publicity rights, or infringes the intellectual property and other proprietary rights, of third parties, or the downloading, copying or use of which is subject to additional terms and conditions, stated or unstated. Voice In Color disclaims any responsibility for any harm resulting from the use by visitors of the Website, or from any downloading by those visitors of content there posted.

4. Copyright Infringement. As Voice In Color asks others to respect its intellectual property rights, it respects the intellectual property rights of others. If you believe that material located on or linked to by accounts under  Voice In Color violates your copyright, you are encouraged to notify Voice In Color in accordance. Voice In Color will respond to all such notices, including as required or appropriate by removing the infringing material or disabling all links to the infringing material. In the case of a visitor who may infringe or repeatedly infringes the copyrights or other intellectual property rights of Voice In Color or others, Voice In Color may, in its discretion, terminate or deny access to and use of the Website.

5. Voice In Color Templates/Themes/Graphics. The custom made templates/themes/graphics by Voice In Color are provided to your through Voice In Color only. These templates (will be indicated) are the sole property of Voice In Color, and not to be used or remake for any other website.

6. Changes. Voice In Color reserves the right, at its sole discretion, to modify or replace any part of this Agreement. It is your responsibility to check this Agreement periodically for changes. Your continued use of or access to the accounts following the posting of any changes to this Agreement constitutes acceptance of those changes. Voice In Color may also, in the future, offer new services and/or features through the Website (including, the release of new hosting plans, prices, templates, tools and resources). Such new features, changes and/or services shall be subject to the terms and conditions of this Agreement.

7. Refunds.  Voice In Color services are provided as agreed.. Voice In Color offer a 30 day money back refund for all hosting plans only. However, if you choose to cancel your hosting plan within the 30 day period, you automatically forfeit your free $5.00 set up fee which is given to you upon sign up for fulfillment of the one year service contract, Voice In Color reserve the right to possibly subtract the $5.00 set up fee upon refund. Any refund request made after the 30 day period will be subject to denial, or possible partial refund if request is made due to significant fault of Voice In Color's server malfunction. Malfunction must be established with reasonable doubt based on Voice In Color's sole discretion. Voice In Color does NOT refund monies on any registered domains that were made through us. (Domains are registered through a third party, this feature is available for the hassle free convenience to our customers). If you register a domain through Voice In Color, the domain belongs to you. If by request, domain information will be released after 90 days or upon satisfaction of payment and with out risk of paypal money retraction for said domain. Voice In Color will not hold domain once these requirements are met. If you choose to cancel your hosting account for what ever reason, the registered domain still belong to you for the registration period (you will be responsible to renew, transfer or cancel the domain/s before or after their expiration period with the third party registrar).

8. Limitation of Liability. In no event will Voice In Color, or its suppliers or licensors, be liable with respect to any subject matter of this agreement under any contract, negligence, strict liability or other legal or equitable theory for: (i) any special, incidental or consequential damages; (ii) the cost of procurement or substitute products or services; (iii) for interruption of use or loss or corruption of data; or (iv) for any amounts that exceed the fees paid by you to Voice In Color under this agreement during the twelve (12) month period prior to the cause of action. Voice In Color shall have no liability for any failure or delay due to matters beyond their reasonable control. The foregoing shall not apply to the extent prohibited by applicable law. Account holders are responsible of backing up and maintaining their accounts and website data.

9. Indemnification. You agree to indemnify and hold harmless Voice In Color, its contractors, server hosting company, licensors, agents from and against any and all claims and expenses, including attorneys’ fees, arising out of your use of the Voice In Color website and services.

10. Miscellaneous. This Agreement constitutes the entire agreement between Voice In Color and you concerning the subject matter hereof, and they may only be modified by the executive of Voice In Color.
